Lend — Terms of Service

Welcome to Lend. These Terms of Service ("Terms") govern your use of the Lend mobile application and related services (collectively, the "Service"), operated by Ishan Daya ("we," "us," or "Lend").

By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old to use Lend. By using the Service, you represent that you meet this requirement. We do not knowingly collect information from anyone under 18.

2. Account Registration

When you create an account, you agree to:

  • Provide accurate, current, and complete information

  • Maintain the security of your account credentials

  • Promptly update any information that changes

  • Take responsibility for all activity that occurs under your account

  • Notify us immediately of any unauthorized use

We reserve the right to refuse service, terminate accounts, or remove content at our sole discretion.

3. Acceptable Use

Lend is a community built on trust. You agree NOT to:

  • Post, share, or send content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, sexually explicit, or otherwise objectionable

  • Harass, intimidate, stalk, or threaten other users

  • Use hate speech, including content that promotes discrimination based on race, ethnicity, religion, gender, sexual orientation, disability, or any protected characteristic

  • Post content involving the sexual exploitation of minors (we report such content to law enforcement)

  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity

  • Post items you do not own, do not have permission to lend, or that are stolen, counterfeit, or otherwise illegal

  • Post items that are dangerous, hazardous, illegal to sell or lend, or restricted (including weapons, drugs, controlled substances, prescription medications, alcohol to minors, etc.)

  • Misrepresent the condition, value, or nature of items you list

  • Use the Service for commercial purposes outside the intended sharing, lending, and giving functions

  • Attempt to access other users' accounts, data, or items without authorization

  • Use automated tools (bots, scrapers, etc.) to access or interact with the Service

  • Interfere with or disrupt the Service or the servers and networks connected to the Service

  • Circumvent any access controls, security measures, or rate limits

  • Engage in any activity that violates applicable laws or regulations

We reserve the right to determine what constitutes a violation of these terms at our sole discretion.

4. User-Generated Content

You retain ownership of content you post on Lend (item descriptions, photos, messages, profile information, etc.) ("User Content"). By posting User Content, you grant Lend a worldwide, non-exclusive, royalty-free license to use, reproduce, display, and distribute your User Content solely for the purpose of operating and providing the Service.

You represent and warrant that:

  • You own or have the necessary rights to your User Content

  • Your User Content does not infringe on any third party's intellectual property, privacy, or other rights

  • Your User Content complies with these Terms and all applicable laws

5. Reporting Objectionable Content

If you encounter content or behavior that violates these Terms, please report it through one of these channels:

  • In-app: Use the report option available on items, profiles, and messages

  • Email: ishan.n.daya@gmail.com

We commit to reviewing reports within 24 hours and taking appropriate action, which may include removing content, suspending accounts, or permanently banning users.

6. Blocking Other Users

You can block other users at any time. When you block someone:

  • They will not appear in your feeds, search results, or recommendations

  • They cannot send you messages or interact with your content

  • The block is silent — the other user is not notified

If you experience harassment, please both block the user AND report them so we can take broader action.

7. Zero Tolerance for Abuse

We have zero tolerance for abusive users. Accounts that engage in harassment, hate speech, threats, or other abusive behavior will be permanently terminated. We may also report illegal activity to appropriate law enforcement authorities.

8. Account Termination

We may suspend or terminate your account at any time, with or without notice, for any reason, including but not limited to:

  • Violation of these Terms

  • Behavior that creates legal or operational risk for Lend or other users

  • Extended inactivity

  • At our discretion

You may terminate your own account at any time through the Settings menu in the app. Upon termination, your account enters a 60-day archive period during which you can cancel by signing back in. After 60 days, your data is permanently deleted, except for anonymized records preserved for operational and historical purposes (such as transaction history with other users).

9. Item Exchanges and Liability

Lend facilitates connections between users for the purpose of lending, borrowing, and giving items. Lend is NOT a party to any transaction between users.

You acknowledge and agree that:

  • All exchanges between users are at your own risk

  • Lend does not guarantee the condition, safety, legality, or quality of items listed

  • Lend is not responsible for damage, loss, theft, or any disputes arising from item exchanges

  • Disputes between users should first be resolved between the parties involved

  • We may, at our discretion, mediate disputes, but we are not obligated to do so

You are responsible for inspecting items before borrowing, communicating clearly with counterparties, and returning items in the condition you received them.

10. Privacy

Your privacy is important to us. Our handling of your personal information is described in our Privacy Policy at ishandaya.com/lend-privacy-policy.

Key principles:

  • We collect only information necessary to operate the Service

  • We do not sell your personal information to third parties

  • Location data is approximate (neighborhood-level) by default until you approve a specific lend

  • Group memberships and friend connections are not visible to other users

11. Intellectual Property

The Service, including its design, code, text, graphics, logos, and other content (excluding User Content), is owned by Lend and protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of the Service without our written permission.

12. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LEND AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE.

Our total liability for any claim arising out of or relating to these Terms or the Service shall not exceed $100 or the amount you have paid to use the Service in the past 12 months, whichever is greater.

14. Indemnification

You agree to indemnify and hold harmless Lend, its operators, and affiliates from any claims, damages, losses, or expenses (including reasonable attorney fees) arising out of your use of the Service, your violation of these Terms, or your violation of any rights of another person.

15. Changes to These Terms

We may update these Terms from time to time. When we do, we will:

  • Update the effective date at the top of this page

  • Notify users of material changes via the app or email

  • Require re-acceptance for significant changes affecting your rights

Continued use of the Service after changes constitutes acceptance of the updated Terms.

16. Governing Law

These Terms are governed by the laws of the State of Illinois, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Cook County, Illinois.
